GIVEAWAY TERMS AND CONDITIONS
Official Rules (“Official Rules”) and Legal Disclaimer
INTRODUCTION
ELIGIBILITY
The Giveaway is open to individual legal residents of the 50 United States or the District of Columbia who are 18 years of age or older. Employees, officers, directors, and contractors of Don Creative Group, anyone involved in the administration of the Giveaway, and any member of the immediate family (i.e., a parent, sibling, child, or grandchild) or household of any of the foregoing individuals are not eligible to enter or win the Giveaway.
GIVEAWAY PERIOD
The Giveaway begins on the date of announcement and ends on September 30th, 2023 (the “Giveaway Period”). Entries will only be accepted during the Giveaway Period.
HOW TO ENTER
To enter the Giveaway, individuals must submit an entry form via the official Giveaway webpage (provide the link to the webpage here) during the Giveaway Period. Each entrant must provide accurate and complete information. Limit one entry per person. To preserve the standards of a Giveaway, Don Creative Group may occasionally ask for additional information that will be used for fraud prevention.
ELIGIBLE PARTICIPANTS
This giveaway is open exclusively to animal shelters that meet the following criteria:
- Must be a registered and recognized animal shelter or rescue organization.
- Must operate within the United States.
- Must comply with all relevant local, state, and federal laws and regulations.
- Must not be affiliated with or operated by Don Creative Group or its employees.
FINALIST SELECTION
All eligible entries will be reviewed and evaluated by Don Creative Group’s internal team. The team will select a finalist based on the criteria of need and alignment with our mission. The decision of the internal team is final and cannot be contested.
PUBLIC VOTE
Once the finalist is chosen by Don Creative Group’s internal team, the selected shelter will be announced on our website and social media platforms. A public vote will then be conducted to determine the ultimate winner of the website giveaway. The shelter with the most votes at the end of the voting period will be declared the winner.
SPONSORS
- 50% of all donations received during the giveaway period will be directly donated to the “Shelter of Choice” (the shelter chosen as the winner).
- The remaining 50% of donations will be used to cover any costs associated with the development and maintenance of the grand prize website.
- In the event that there are funds left over from the Grand prize website budget, these funds will also be donated to the “Shelter of Choice.”
GRAND PRIZE
The prize for the Giveaway is a fully functional WordPress website, including website design and development, to be provided by Don Creative Group. The prize is non-transferable, and no cash or other substitutions are allowed. Don Creative Group will work with the winner to design and develop the WordPress website based on the specific needs and requirements of the animal shelter.
NOTIFICATION OF WINNER
The winning shelter will be notified via email and/or phone within 14 days after the conclusion of the public vote. The shelter must respond to claim the prize within 30 days of notification, or an alternate winner may be selected.
USE OF THE WEBSITE
The WordPress website provided as the prize is for the exclusive use of the winning animal shelter and must not be sold, transferred, or used for any commercial purposes. The website will be subject to Don Creative Group’s standard terms of service.
LIMITATION OF LIABILITY
By participating in the Giveaway, participants agree to release and hold harmless Don Creative Group and its affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) their participation in the Giveaway, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware, or software, (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service, and (iv) unauthorized human intervention in any part of the entry process or the Giveaway.
GENERAL CONDITIONS
Don Creative Group reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Giveaway for any reason, including but not limited to fraud, technical failures, or any other causes that affect the administration, security, fairness, integrity, or proper conduct of the Giveaway. In such an event, Don Creative Group may select the winner from among all eligible entries received prior to and/or after the action taken by Don Creative Group. Don Creative Group reserves the right to disqualify any individual who tampers with the entry process or violates these Official Rules.
PRIVACY POLICY
Any personal information collected during the Giveaway will be used in accordance with Don Creative Group’s Privacy Policy.
DISPUTES
The Giveaway is governed by the laws of the United States and the state of Florida, without respect to conflict of law doctrines. Any and all disputes, claims, causes of action, or controversies arising out of or in connection with the Giveaway shall be resolved by arbitration.
